Subscription Agreement

This Subscription Agreement ("Agreement") is a legally binding contract between you ("Subscriber," "you," or "your") and Progressivity LLC, doing business as FLXR ("FLXR," "we," "us," or "our"). By creating an account and subscribing to any FLXR plan, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Subscription Plans

FLXR offers the following subscription plans (collectively, "Plans"):

  • Scale — $999.00 per month (monthly billing) or $899.00 per month billed annually ($10,788.00 per year)
  • Enterprise — $2,999.00 per month (monthly billing) or $2,699.00 per month billed annually ($32,388.00 per year)

Additional plans may be introduced at FLXR's discretion. All plans are subject to the terms outlined in this Agreement.

2. Billing & Payment

By subscribing to a Plan, you authorize FLXR to charge the payment method you provide through our payment processor, Stripe, Inc. ("Stripe"), for the applicable subscription fees. Charges will recur automatically at the start of each billing cycle (monthly or annually, depending on your selected billing interval) unless you cancel your subscription before the next renewal date.

You are responsible for keeping your payment information current. If a payment fails, FLXR may suspend or terminate your access until payment is successfully processed.

3. No Refund Policy

ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. BY SUBSCRIBING TO ANY FLXR PLAN, YOU ACKNOWLEDGE AND AGREE THAT:

  • No refunds will be issued for any subscription fees already charged, including but not limited to partial months, unused portions of a billing cycle, or any period during which you did not use the service.
  • No prorated refunds will be provided upon cancellation. If you cancel your subscription, you will retain access to the service through the end of your current billing period, but no refund will be issued for the remaining time.
  • Downgrading or switching plans does not entitle you to a refund of the difference in plan pricing.
  • Annual subscriptions are charged in full at the time of purchase. No partial refunds will be issued if you cancel before the annual term expires.
  • FLXR is not obligated to provide refunds, credits, or compensation for any reason, including but not limited to: service dissatisfaction, technical issues, feature changes, platform downtime, or changes to your business needs.

4. Cancellation

You may cancel your subscription at any time through your FLXR dashboard (Settings → Billing → Manage Subscription) or via the Stripe Customer Portal. Upon cancellation:

  • Your access to FLXR's paid features will continue through the end of your current billing period.
  • No further charges will be made after the current billing period ends.
  • No refund will be issued for the current or any prior billing period.
  • Your account data may be retained for up to 30 days after cancellation, after which it may be permanently deleted.

5. Service Availability

FLXR strives to maintain high availability of its platform but does not guarantee uninterrupted service. Scheduled maintenance, technical issues, or third-party service disruptions (including but not limited to social media platform changes, API modifications, or infrastructure provider outages) may affect service availability. Such disruptions do not entitle you to a refund or credit.

6. Changes to Plans & Pricing

FLXR reserves the right to modify subscription plans, pricing, and features at any time. If pricing changes affect your current plan, you will be notified at least 30 days before the change takes effect. Continued use of the service after a pricing change constitutes acceptance of the new pricing.

7. Acceptable Use

You agree to use FLXR in compliance with all applicable laws and the terms of service of any third-party platforms (including Reddit, X/Twitter, and LinkedIn). FLXR may suspend or terminate your account without refund if you:

  • Use the platform for spam, harassment, or illegal activities
  • Violate third-party platform terms of service
  • Attempt to reverse-engineer, resell, or redistribute FLXR's technology
  • Share your account credentials or license key with unauthorized parties

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLXR'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO FLXR IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FLXR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from this Agreement shall be resolved in the courts located in Texas.

10. Entire Agreement

This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and FLXR regarding your use of the service. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
